This is a binding contract between the Participant and the Promoter.\u00a0 <\/span>If the Participant does not agree to be bound by the terms, the Participant should not enter the Promotion \/ Competition.<\/span><\/span><\/p>\n THE PROMOTER<\/b>: UniDraw Ltd. (referred to herein as \u201cUniDraw\u201d or \u201cPromoter\u201d) is a United Kingdom corporation and a for-profit, commercial company.\u00a0<\/span><\/p>\n THE WEBSITE<\/b>: The www.unidraw.co.uk website (the \u201cWebsite\u201d) allows individuals to enter prize-draws hosted on the Website (each a \u201cPromotion\u201d or \u201cCompetition\u201d).<\/span><\/p>\n <\/b>1. Qualifying Persons<\/b><\/span><\/p>\n 1.1<\/strong> Our competition is open to persons aged 18 or over. This promotion is void where local national laws prohibit or restrict participation.<\/span><\/p>\n 1.2<\/strong> The Competition is not open to employees and \/ or Directors of the Promoter and their immediate families, their affiliated brands and companies or any other persons professionally connected with the Competition.\u00a0<\/span><\/p>\n 1.3 <\/strong>The Promoter shall not make any representations or deemed to have made any representations, express or implied, as to the lawfulness of any individual\u2019s participation, or as to any other aspect of any Promotion.\u00a0<\/span><\/p>\n <\/b>2. Legal Undertaking<\/b><\/span><\/span><\/p>\n 2.2 <\/strong>Participation in the Competition constitutes acceptance of the Terms. By entering the Competition all Participants will be deemed to be bound by the Terms.<\/span><\/p>\n 2.2 <\/strong>In the event of any dispute regarding the conduct of the Competition and all matters relating to the Competition, the decision of the Promoter is final and binding and no correspondence or discussions will be entered into.<\/span><\/p>\n 2.3 <\/strong>The Competition shall be governed by English law and all and\/or any matters or disputes relating to the Competition will be dealt with and\/or resolved under English Law and the County Court at Magistrates shall have exclusive jurisdiction.<\/span><\/p>\n 2.4 <\/strong>In the event that the Participant enters a Competition thus accepting these terms and conditions, the Participant hereby confirms that they are not breaching any laws in their country of residence regarding the legality of entering the Competition. <\/span><\/p>\n 2.5 <\/strong>The Promoter is not responsible for a Participant entering a Competition unlawfully. If in any doubt, the Participant should immediately leave the Website and check with the relevant authorities in their country of residence.<\/span><\/p>\n 2.6 <\/strong>Entries from agents, third parties, organised groups or entries automatically generated by computer will not be accepted.<\/span><\/p>\n <\/b>3. The Prize<\/b><\/span><\/p>\n 3.1 <\/strong>The winner of the Competition shall receive the prize(s) identified on the Promoter\u2019s Website.<\/span><\/p>\n 3.2 <\/strong>Where applicable, the Winner is liable for all and any taxes associated with the Prize.<\/span><\/p>\n 3.3 <\/strong>The Promoter does not imply or give any warranty or accept any valuation to the Prize. The Participant must make their own decision through undertaking their own reasonable enquiries and take legal advice where appropriate before entering the competition.<\/span><\/p>\n 3.4 <\/strong>Collection of the prize is the sole responsibility of the winner, from the Promoter\u2019s address unless otherwise agreed between the Promoter and the Winner.<\/span><\/p>\n 3.4 <\/strong>The winner will be required to provide proof of identity and proof of entry into the competition at the time that the prize is collected.<\/span><\/p>\n 3.5 <\/strong>The Prizes are non-transferable, unless agreed in writing by the Promoter and no cash alternative is available. The Promoter reserves the right to substitute the Prizes for similar prizes of equal or greater value at any time.<\/span><\/span><\/p>\n <\/b>4. Entering the Competition<\/b><\/span><\/span><\/p>\n 4.1 <\/strong>Each Promotion will have a start date and time and an end date and time (the \u201cEntry Period\u201d). Only those entries received by Promoter during the Entry Period will be valid. The Promoter or such other person or corporation instructed by the Promoter will be the official timekeeper for all Promotions.<\/span><\/p>\n 4.2 <\/strong>All Promotions will provide the following two (2) methods of entry:<\/span><\/p>\n (i) Paid Method of Entry<\/b>: To enter by this method, visit www.unidraw.co.uk and select the \u201center now\u201d button on the webpage. Choose the applicable entry fee amount(s) to purchase entries (\u201cEntry Fee\u201d). Each Entry Fee amount will come with a set number of entries into the Promotion. Follow the instructions to enter your full, legal name, contact details as requested and payment information.\u00a0 <\/span>You should then complete your payment. Once your payment is complete, you will automatically receive the number of entries you selected for a chance to win the Promotion.\u00a0 <\/span>There is no maximum entry limit.\u00a0<\/span><\/span><\/p>\n (ii) Alternate Method of Entry<\/b>:\u00a0 <\/span>The Participant shall print their full, legal name, home address (a post office box address will not be accepted) to include city and post code, phone number (optional), email address and the Full Name of the Promotion they want to enter in either postcard or letter format.\u00a0 <\/span>The Participant must ensure there is enough detail and as such, no ambiguity as to which draw the Participant wishes to enter.\u00a0 <\/span>The date of the draw shall be included (for example, \u201cUniDraw \u2013 Student Loan Draw \u2013 June 22\u201d).\u00a0 <\/span>The completed Entry is to be posted to the Promoter\u2019s third-party prize draw vendor at [insert <\/i>address] within the Entry Period.\u00a0 <\/span>The specified limit is one (1) entry per outer mailing postal format. Each eligible entry received via the Alternate Method of Entry will be equivalent to a single entry into the Promotion, with effect from the date that an entry is received and processed. Mechanically produced entries are not permitted. Illegible entries will be deemed void. The Promoter is not responsible for lost, late, mutilated, delayed, inaccurate, incomplete, postage due, misdirected entries.\u00a0 <\/span>Entries not received by 23:59:59 (GMT) on the last day of the specified Entry Period will not be accepted and will be deemed void. <\/span><\/p>\n 4.3\u00a0 <\/strong>The Promoter reserves the right to refuse or disqualify any incomplete Entry if it has reasonable grounds for believing that the Participant has contravened any of these terms and conditions.<\/span><\/p>\n 4.4 <\/strong>To the extent permitted by applicable law, all Entries become the Promoter\u2019s property and will not be returned to the Participant.<\/span><\/p>\n 4.5 <\/strong>There is no cumulative maximum number of entries that any one Participant may obtain. The Promoter will not refund any Entry Fees that relate to void and\/or ineligible entries and\/or those that exceed the applicable Entry Limit.<\/span><\/p>\n 4.6 <\/strong>All Participants (including those entering for free) must create an account prior to entering and supply an email address to proceed in the Competition.<\/span><\/p>\n 4.7 <\/strong>Late, incomplete or corrupted entries or those not made in accordance with the Terms will be automatically disqualified. Winner Selection <\/b><\/span><\/p>\n 5.1 <\/strong>The winner of the Competition shall be determined by using a verifiably random process from among all eligible entries received. <\/span><\/p>\n 5.2 <\/strong>Due to the nature of the selection, there will only be one Winner of the Competition, unless the Promoter states otherwise.<\/span><\/p>\n 5.3 <\/strong>The winner will be contacted as soon as practicable after the draw, and in any event within 7 business days (Monday to Friday), using the email address provided by the winner. The original winner who supplied incorrect contact details will have no claim to the prize.\u00a0<\/span><\/p>\n 5.4 <\/strong>The winner is to respond within 7 business days.\u00a0 <\/span>The winner must accurately complete and return any required documentation within the specified time-period.\u00a0 <\/span>If the winner fails to provide the required documentation within the specified time, the winner may be disqualified.\u00a0 <\/span>This will be at the discretion of the Promoter.<\/span><\/p>\n 5.4 <\/strong>The Promoter reserves the right to conduct background\/security checks at its discretion.\u00a0 <\/span>The potential winner agrees to comply with such checks.\u00a0 <\/span>The Promoter reserves the right to disqualify the potential winner based upon the results and is not obliged to inform or clarify the details of the results.<\/span><\/p>\n 5.6 <\/strong>If for any reason the Promoter is unable to contact a Winner within 7 business days, or the potential winner fails for whatever reason or cause to confirm acceptance of the Prize and\/or the Winner is disqualified based upon these terms, the potential winner will immediately, irrevocably and automatically forfeit the Prize and the Prize will remain in the possession and ownership of the Promoter.<\/span><\/p>\n 5.7 <\/strong>A winner can decline some or all of the prize.\u00a0 <\/span>In this instance, there is no obligation on the Promoter to award the prize remaining to an alternate winner.<\/span><\/p>\n 5.8 <\/strong>The Prize is not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. In the rare instance that a prize becomes unavailable, the Promoter will offer an alternative prize of equal or higher value.<\/span><\/p>\n 5.10 <\/strong>In the event that the Promoter closes the Competition early, a Winner will be selected from all valid and eligible Entries received by the Promoter by the date of early closure, except that the Promoter reserves the right, at its sole discretion, to close the Competition early without selecting a Winner. In the event that the Competition is closed without selecting a Winner, the Promoter will give all Entrants credit to enable them to replay equivalent Tickets in a subsequent Competition. Winner\u2019s Details<\/b><\/span><\/p>\n 6.1 <\/strong>The Winner consents to have their photo and video taken by the Promoter and absolutely and irrevocably authorises the Promoter as well as its legal representatives, assignees, and transferees to use, publish, reuse, republish, distribute, disseminate or otherwise make publicly available such images for any artistic or commercial use, including advertising, publication, or illustration. <\/span><\/p>\n 6.2 <\/strong>The Promoter can publish details of the winner (surname and county of residence).<\/span><\/p>\n 6.3 <\/strong>The Winner understands and agrees that having their photo and video and details published is a condition to claiming the Prize. In the event the Winner refuses to do so, the Winner is not eligible to receive the Prize.<\/span><\/p>\n 6.4 <\/strong>Following receipt and verification of the details requested above by the Promoter and provided that the Winner has satisfied these terms and conditions, the Winners will be contacted by email, in order to make arrangements to confirm, verify and arrange delivery of the Prize.<\/span><\/p>\n <\/b>7. Limitations of Liability<\/b><\/span><\/p>\n 7.1 <\/strong>The Promoter makes or gives no representations and\/or warranties and\/or assurances of whatever nature and howsoever arising (and whether in writing or otherwise) as to the quality, suitability and\/or fitness for any particular purpose of any of the cars advertised, offered and\/or provided as Prizes. <\/span><\/p>\n 7.2 <\/strong>No responsibility will be accepted by the Promoter for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes.<\/span><\/p>\n 7.3 <\/strong>The Promoter shall use its reasonable endeavours to award the Prize for the Competition to the correct Participant. If due to reasons of hardware, software or other computer related failure, or due to human error, the Prize is awarded incorrectly, the Promoter reserves the right to reclaim the Prize and award it to the correct Participant, at its sole discretion and without admission of liability and the Participant that has been incorrectly awarded the Prize will immediately at the Participant\u2019s own cost and expense return it to the Promoter and\/or pay the Promoter for that Prize (at the discretion of the Promoter).<\/span><\/p>\n 7.4 <\/strong>Insofar as is permitted by law, we, our agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by our negligence or that of our agents or distributors or that of their employees.
